Terms of Service

These Terms of Service ("Terms") govern your use of the Mely mobile application (the "app") provided by Mely ("Mely", "we", "us"). By downloading, accessing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

Medical disclaimer. Mely is a personal tracking tool, not a medical device or healthcare provider. It does not provide medical advice, diagnosis, or treatment, and does not replace the guidance of your doctor or pharmacist. Always follow your prescribing healthcare provider's instructions regarding your medication, dosing, and treatment. Never disregard professional medical advice or delay seeking it because of something in the app. If you may be experiencing a medical emergency, contact your local emergency services immediately.

Eligibility

You must be at least 13 years old to use Mely. If you are under the age of majority in your jurisdiction (typically 18), you may only use the app with the involvement and consent of a parent or legal guardian who agrees to these Terms. By using the app, you represent that you meet these requirements.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date.

Subscriptions & Billing

Mely may offer auto-renewing subscriptions purchased through the Apple App Store.
Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Manage or cancel your subscription in your App Store account settings.
If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
Except where required by law, payments are non-refundable; refund requests are handled by Apple under the App Store terms.

Acceptable Use

You agree not to:

Use the app for any unlawful purpose or in violation of these Terms.
Attempt to reverse engineer, disrupt, or gain unauthorized access to the app or its systems.
Upload content that is unlawful or infringes the rights of others.

Your Content

You retain ownership of the data and photos you add to Mely. You grant us a limited license to store and process that content solely to operate the app and provide its features to you, as described in our Privacy Policy.

Disclaimers

The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any estimates, projections, or summaries it produces are accurate.

Limitation of Liability

To the maximum extent permitted by law, Mely and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the amount you paid us in the twelve months before the claim.

Apple App Store

These Terms are between you and Mely only, not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

Changes to the App or Terms

We may modify or discontinue features, and may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Your continued use of the app after changes take effect constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict-of-law rules. You agree that any dispute not subject to arbitration or small-claims court will be brought exclusively in the state or federal courts located in Nevada.
